Terms and Conditions

These Terms and Conditions apply to the sale of artwork and related goods by Sean Byrne trading as Chanbhas (“Chanbhas”, “I”, “me” or “my”) through chanbhas.com, and to purchases arranged directly through the website, email or another agreed distance-selling method.

They should be read together with the Chanbhas Privacy Policy and any specific information provided in relation to an individual artwork or commission.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

1. About Chanbhas

Chanbhas is the artist website of Sean Byrne and offers original paintings, commissioned artwork and, where indicated, prints or other reproductions.

2. Original Artwork

Unless otherwise stated, paintings described as original artworks are unique physical works created by Sean Byrne.

Only one physical original of each original artwork exists.

The purchase of an original artwork transfers ownership of the physical artwork only. Copyright and reproduction rights are dealt with separately under the Intellectual Property and Copyright section below.

Where an artwork is sold framed, this will be stated in the description. Any frame, room setting or other item shown in photographs is not included unless expressly stated.

3. Artwork Descriptions and Images

Every reasonable effort is made to describe and photograph artwork accurately.

Because paintings are physical, textured objects and because colours vary between computer screens, phones and other displays, the appearance of an artwork on screen may differ slightly from the physical work.

Dimensions are stated as accurately as reasonably possible. Minor variations may occur, particularly with handmade, mixed-media and textured works.

Images displayed on the website may not necessarily represent the artwork to scale.

4. Availability

Original paintings are unique and may also be displayed or offered for sale at exhibitions, galleries or other locations.

An artwork appearing on the website is therefore not guaranteed to remain available until a sale has been confirmed.

If an artwork is purchased or reserved elsewhere before an online or distance transaction has been completed, I will inform you as soon as reasonably possible and refund any payment already received.

5. Orders and Formation of Contract

An enquiry, order request or payment does not necessarily constitute acceptance of an order.

A contract for the sale of an artwork comes into effect when:

  • the availability and details of the artwork have been confirmed;
  • the purchase price and any delivery charges have been agreed;
  • any required payment has been received or authorised; and
  • confirmation of the order has been provided.

I reserve the right not to accept an order where, for example, an artwork is no longer available, payment cannot be authorised, delivery cannot reasonably be arranged, or an obvious pricing or description error has occurred.

You must be at least 18 years of age to enter into a contract to purchase through the website.

6. Prices and Payment

Prices are stated in euro (€) unless otherwise indicated.

The price displayed or agreed before purchase will be the price payable for the artwork. VAT will be included where applicable.

Delivery, packaging or other agreed charges will be identified separately before you commit to the purchase.

Payment may be made using the payment methods displayed on the website or otherwise agreed when the purchase is arranged.

Ownership of an artwork does not transfer until payment has been received in full.

7. Delivery and Collection

Delivery arrangements and charges will be confirmed before purchase.

Where a delivery date has been specifically agreed, I will make reasonable efforts to meet that date. Where no particular date has been agreed, delivery will be made within the timeframe required by applicable consumer law.

Artwork will normally be appropriately packaged for transport.

Responsibility for the artwork remains with Chanbhas until you, or a person nominated by you, takes physical possession of it.

If you independently appoint your own courier or carrier, responsibility may transfer when the artwork is handed to that carrier, as provided under applicable law.

Collection may also be arranged where agreed.

8. Cancellation of Online and Distance Purchases

Where you purchase an existing, non-personalised artwork online, by email, telephone or through another distance-selling arrangement, you will generally have a statutory right to cancel the purchase without giving a reason.

For most such purchases, you may notify me of your decision to cancel within 14 days of taking physical possession of the artwork.

After notifying me of cancellation, the artwork should be returned within a further 14 days.

You may use the cancellation form at the end of these Terms and Conditions, although you are not required to use that particular form.

This statutory cooling-off right does not generally apply to artwork made to your specifications or clearly personalised for you. See the section on Commissioned Artwork below.

For artwork purchased in person, including at an exhibition or event, there is normally no statutory change-of-mind cancellation right. This does not affect your rights where goods are faulty, damaged or not as described.

9. Returns Following a Change of Mind

Where the statutory cancellation right applies, you are responsible for the direct cost of returning the artwork unless otherwise agreed.

For large artworks which cannot reasonably be returned by normal postal services, information concerning the likely cost or arrangements for return will be provided before purchase.

Please return artwork with reasonable care and, wherever practical, use the original protective packaging.

You may inspect the artwork as would reasonably be necessary to establish its nature and characteristics. You may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose.

Where a valid cancellation is made, the purchase price and the cost of standard outbound delivery, where applicable, will be refunded. Additional delivery costs resulting from your choice of a more expensive delivery method need not be refunded.

Refunds will normally be made using the original payment method and within the period required by applicable consumer law. I may withhold reimbursement until the artwork has been returned or you provide evidence that it has been sent back.

10. Commissioned and Personalised Artwork

Commissioned artwork will be subject to an agreed brief.

Before work begins, the principal details should normally be confirmed in writing, including as appropriate:

  • subject matter;
  • approximate dimensions;
  • medium and support;
  • price;
  • deposit or staged payment arrangements;
  • framing requirements;
  • estimated completion time; and
  • delivery or collection arrangements.

Creating an original artwork necessarily involves artistic interpretation. Sketches, digital concepts, photographs, colour references or preliminary discussions are intended to establish direction but do not constitute a guarantee that the completed painting will reproduce them exactly.

Reasonable changes may be discussed during the agreed development process. Material changes requested after work has commenced may result in additional costs or an amended completion date.

Where you supply photographs, images or other material for use in a commission, you confirm that you have the necessary permission or rights for me to use that material for the agreed purpose.

Because commissioned works are normally made to a customer’s specifications or are clearly personalised, the statutory change-of-mind cancellation right applicable to ordinary online purchases will generally not apply.

Any deposit, cancellation and payment arrangements specific to a commission will be stated when the commission is agreed.

Your statutory rights in relation to faulty goods or goods that do not conform to the agreed contract remain unaffected.

11. Damaged, Faulty or Incorrect Artwork

Please inspect artwork reasonably soon after delivery.

If an artwork arrives damaged, appears to have been damaged in transit, is faulty or is materially different from the artwork ordered, please contact me as soon as reasonably possible at:

Photographs of the artwork and packaging may be requested to help establish what has happened and to assist with any courier or insurance claim.

You do not lose your statutory rights merely because you were unable to inspect the parcel in the presence of the courier.

Where goods do not conform to the contract, the remedies available to you will be those provided under applicable consumer law, which may include repair, replacement, price reduction or refund depending upon the circumstances.

12. Intellectual Property and Copyright

This section is particularly important in relation to original artwork.

Purchasing an original painting gives the purchaser ownership of the physical artwork.

Unless expressly agreed otherwise in a separate written agreement signed by Sean Byrne, copyright and all reproduction and intellectual property rights in the artwork remain with Sean Byrne / Chanbhas.

The sale of an original painting does not transfer copyright or reproduction rights to the purchaser.

Sean Byrne / Chanbhas therefore retains the right to:

  • photograph and digitally reproduce the artwork;
  • display images of the artwork on websites, social media and other digital platforms;
  • use images of the artwork for exhibitions, portfolios, catalogues, books and promotional material;
  • produce and sell prints or other reproductions of the artwork;
  • create derivative or related artistic works;
  • license reproduction of the artwork to third parties; and
  • otherwise exercise the rights available to the copyright owner.

The purchaser may display, gift or resell the physical original artwork.

The purchaser may also photograph the artwork for reasonable personal purposes, insurance records, non-commercial social-media use or for the purpose of advertising the lawful resale of the original.

The purchaser may not, without prior written permission:

  • manufacture or sell prints or reproductions;
  • use the artwork or an image of it for commercial purposes;
  • license the image to another person or organisation;
  • reproduce the artwork on merchandise or other products; or
  • otherwise commercially exploit the copyright in the artwork.

Where a commissioned artwork contains a private or personal subject, including identifiable individuals, any intended use of images of that commissioned work by Chanbhas for publicity, portfolio or reproduction purposes may be separately agreed with the customer.

13. Website Content

Unless otherwise stated, the content of chanbhas.com, including artwork images, photographs, text, graphics, branding and logos, is owned by or licensed to Chanbhas and is protected by applicable intellectual-property law.

You may view and use the website for personal and non-commercial purposes.

You may share links to Chanbhas content and may share artwork images for reasonable non-commercial purposes provided that the artwork is not materially altered and appropriate credit is given to Sean Byrne / Chanbhas.

Website content may not be copied, reproduced, republished, commercially distributed or used to create products or other commercial material without prior written permission.

14. Privacy

Personal information provided in connection with an enquiry, purchase, commission or newsletter subscription will be handled in accordance with the Chanbhas Privacy Policy.

Payment-card information is handled by the relevant payment provider and is not retained by Chanbhas except to the extent expressly stated in the Privacy Policy.

15. Statutory Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or reduce rights available to consumers under Irish or applicable European consumer law, including the Consumer Rights Act 2022.

If any provision of these Terms and Conditions conflicts with a mandatory legal right, the statutory right will prevail.

16. Business Purchasers

These Terms are primarily written for sales to consumers.

If you acquire artwork wholly or mainly for business, commercial or organisational purposes, certain statutory consumer protections may not apply. Different or additional written terms may be agreed where appropriate.

17. Changes to These Terms

These Terms and Conditions may be updated periodically to reflect changes in the website, business practices or applicable law.

The version applicable to a purchase will normally be the version provided or made available when the relevant contract is entered into.

Changes published subsequently will not retrospectively alter an existing sales contract.

18. Governing Law

These Terms and Conditions are governed by the laws of Ireland.

If you are a consumer resident outside Ireland, this does not deprive you of any mandatory consumer protections or rights available to you under applicable law.
